Protests held to advocate for protection of immigrant rights

Immigrant rights advocates scheduled demonstrations all around the country last weekend, January 14 and 15. The Coalition for Humane Immigrant Rights of Los Angeles spokesman Jorge-Mario Cabrera said of the protests, “This is our first salvo to what may be a long, drawn out campaign.”

The demonstrations are the latest movement in the advocacy that has progressed since 2006 when over one million people protested a Republican-backed immigration bill that would have made it possible to criminally prosecute people in the country illegally. Rallies last weekend culminated at a church in Washington, at a teachers’ union hall in Chicago, and in Los Angeles and San Jose.

Demonstrations were sparked by President-elect Donald Trump’s campaign rhetoric that he would implement tougher immigration policies and penalties. However, some people are hesitant to join the rallies without the action Trump is referencing. University of California, Berkeley professor of ethnic studies Chris Zepeda-Millan said, “Right now, all we have is these vague kinds of promises. Attacks have to occur for people to mobilize.”

Immigrant workers may be subject to e-verification

Texas Lieutenant Governor Dan Patrick plans to make Senate Bill 23 into a law in the upcoming legislative session. The bill was filed by Texas State Senator Charles Schwertner and seeks to require state contractors to use a federal electronic verification system to ensure the immigrants they are hiring have legally immigrated to the United States.

If the bill gets approved, it will codify an executive order regarding e-verify issued by former Texas Governor Rick Perry in 2014. Ana Gonzalez, a member of the Workers Defense Project, said the measure seeks to negatively impact both undocumented workers and businesses because half the state’s construction industry workforce comes from immigrant workers.

Our lawyers at the Law Office of William Jang, PLLC provide legal services for our clients in Austin and other areas in Texas. Austin city leaders promise to uphold civil rights of citizens

Anxieties have risen over immigration concerns ever since election day, as Donald Trump has stated he will be especially vigilant when it comes to deporting undocumented immigrants. Aside from this, reports of racially motivated attacks against Latinos and Muslims have increased.

City leaders in Austin, Texas confirmed there has been a rise in phone calls from people who have expressed their fears regarding mass deportations and hate crimes. In response to this, several Austin council members plan on teaming up with Austin Independent School District school board members and Travis County leaders at City Hall to craft measures that will ensure civil rights of residents are protected.

Travis County Sheriff-Elect Sally Hernandez is adamant that no rights of citizens will be violated. She noted, “Travis County voters made it overwhelmingly clear that they want a progressive policy towards [immigration] that focuses on keeping families together and our community safer. Our values have not changed since Election Day. Travis County still has the same principles and values which state that everyone regardless of who they are, who they love, or where they come from should be valued, respected, and treated fairly by law enforcement..”

A lot of people look to start their new lives in the United States, as they view the country as a land filled with new and promising opportunities for them. However, sometimes plans of immigrating to the country stall as they encounter difficulties with the process of immigration. If you have experienced immigration problems in the U.S., do not hesitate to contact our attorneys at the Law Office of William Jang, PLLC by calling our Austin offices at (512) 323-2333.

Austin immigrant families worried about living under Trump

Immigrant families in central Texas communicated feelings of anxiousness that President-elect Donald Trump will deliver on his campaign promise to deport millions of immigrants from the United States.

One such person is Alex, a single mother who has two boys, one of whom was born in the country. She is hoping his citizenship can afford her children some protection from deportation, saying, “America is the country for opportunities, right, so I decided to take the opportunities for my kids and for myself, too.”

Two policies of President Barack Obama likely to be scrapped once Trump assumes the presidency are the Deferred Action for Childhood Arrivals (DACA), which enables children brought to the country illegally to stay and work here temporarily, and the Deferred Action for Parental Accountability (DAPA), which provides protection for undocumented parents of American citizens.

As immigration attorneys, we at the Law Office of William Jang, PLLC know how challenging it is for many immigrants in this country – from the first step of processing immigration papers to actually living in the United States. Progressives and conservatives torn on Travis County Jail-ICE cooperation

Full cooperation between Immigration and Customs Enforcement authorities and personnel at the Travis County Jail in Texas might come to an end in January 2017 with the election of Democratic Constable Sally Hernandez. Hernandez, who won the Travis County Sheriff position in November, has said she is not in favor of turning over undocumented immigrant jail detainees to federal agents.

Progressives and conservatives have differing views about the matter. The former say law enforcement programs already in place tend to make the challenges that immigrant families already face worse, and the latter say federal ICE programs contribute to deterring criminality. Criminal justice reform group Grassroots Leadership executive director Bob Libal says, “If whoever the sheriff is adopts a policy like many of these other communities around the country that limits ICE’s ability, that is a good thing for immigrants, and it is a good thing for public safety.”

Dating site tells undocumented immigrants to ‘get a sugar daddy’ in Austin billboard

ArrangementFinders, a dating website for sugar babies looking for sugar daddies, has recently come under fire for suggesting that undocumented immigrants try to secure a benefactor prior to getting deported.

“Undocumented immigrant?” asks the billboard, which is situated along a highway in South Austin. ”Before you get deported, get a sugar daddy,” the billboard, which features a Latina woman in front of a Mexican flag, adds. The billboard ad is implying that undocumented people can become vulnerable, especially because of Donald Trump threatening that he will tighten the reins on immigration policies. Trump has said he would consider the deportation of undocumented immigrants a priority

ArrangementFinders’ parent company, Ruby Inc., which owns the controversial dating service Ashley Madison, has distanced itself from the ad, saying in a statement: “The billboard is created independently by an affiliate…is completely unacceptable and does not reflect the views or visions of the company, so we have requested that they take it down immediately.”

Austin woman and son granted deferred action

Austin resident Hilda Ramirez and her son Ivan Juarez were granted deferred action by the United States Immigration and Customs Enforcement on Wednesday, October 19. In other words, instead of being deported at the soonest possible time, the federal government will decide if they should leave the country next year. Hilda and Ivan are here after fleeing violence in Guatemala.

For the past eight months, Ramirez and her son, who is now 10 years old, have stayed at Austin’s St. Andrews Presbyterian Church, where they gave them sanctuary during the legal battle for asylum. Grassroots Leadership immigration organizer Alejandro Caceres said Ramirez deserved the deferred action. Ramirez spent 11 months in a Texas detention facility back in August 2014 when she and her son first came to the United States. “She is able to apply for a work permit, in that year. Able to be in the United States, have an ID, have a social security, and able to work,” said Caceres.

ICE practice of detaining prisoners deemed illegal

A federal district court order from the Northern District of Illinois says it is illegal for federal authorities with Immigration and Customs Enforcement to issue a detainer on people detained within local law enforcement.

Explaining the decision, Director of the Immigration Clinic at the University of Texas School of Law Denise Gilman said: “The entire way in which ICE issues and implements its detainer program right now is likely unlawful. Because ICE isn’t going before any court, any magistrate, anybody at all to have a finding of probable cause.”

Texas Civil Rights Project community director Zenen Jaimes welcomed this development and added: “Thankfully I’m in a place where you know, we’re fighting some of these abuses that we still think happen in Travis Country and all over the state.”

Nearly 1,200 immigrants naturalized as United States citizens

Almost 1,200 immigrants from over 90 countries attended Delco Center in Northeast Austin last Thursday, September 29 to earn the same rights, benefits, and responsibilities as native-born United States citizens.  The citizens completed their naturalization process after they were sworn in by U.S. District Court Judge Robert L. Pitman.

Citizenship and Immigration Services records showed over 700,000 immigrants were naturalized all over the country in 2015. Susan Cooper, who was originally from England, welcomed the development, saying, “It’s financial security, [and] an honor to friends I’ve lived and worked with. Now I’m part of the country instead of just a visitor.” Thirty-eight-year-old Kritan Gurung, originally from Nepal, said that now that he is a U.S. citizen, he can invite his parents for a visit very soon.

Travis County sheriff raises concerns over likely successor’s immigration policy

In an onstage interview at the Texas Tribune Festival on Saturday, September 24, Travis County Sheriff Greg Hamilton raised concerns about the feasibility and soundness of the campaign promises made by fellow Democrat Sally Hernandez, a constable deemed most likely to win Hamilton’s position come November.

Hamilton was featured along with Dallas County Sheriff Lupe Valdez on the panel discussion titled “Immigration and the Cities” at the Texas Tribune Festival. Hernandez, who is running against her Republican counterpart, Joe Martinez, favors making Austin a “sanctuary city” for illegal immigrants and believes you can’t “solve the criminal justice process by deporting them.”

According to the United States Immigration and Customs Enforcement, the majority of local law enforcement agencies limiting cooperation with the federal government when it comes to handling local immigrants are in California.
