United States District Court Judge Arthur Schwab ruled o December 16 in Pennsylvania that President Barack Obama’s executive immigration order is unconstitutional, according to the Washington Post.
According to Schwab, the order “violates the separation of powers provided for in the United States Constitution as well as the Take Care Clause.” The Take Care Clause is simultaneously something that imposes a “duty” on the president and something that can be classified as the source of presidential “power.”
Schwab’s ruling, however, does not directly challenge the executive decision made by the president; it merely serves as legal bullet for the immigration order’s critics. The impact that Schwab’s ruling hopes to achieve is as of the moment unclear.
The immigration order, which seeks to grant at least 5 million illegal aliens in the country legal status, has faced fire from critics all over the country. Republicans from the House of Representatives filed a bill on December 4 to declare the executive order null and void.
